So yesterday I got in a car crash. I was hit from behind, luckly she wasn't going fast.
here is the story:
A lady in a Lexus ES 300H hit a white Toyota Pruis, then the Toyota pruis hit me. My 2014 VW Jetta TDI.
I haven't have the car very long.
I have many questions?
what if I get hurt from this?
what if I need to get a new car?
I dont know if I have the money for another down payment?
anyways I would love to see what you guys think?

Call your insurance.
Then call the lady's insurance and ask it to cover the repair of your vehicle.

Did you call the police, did you get a police report, on the accident? Did you take photos of the collision. If your vehicle is covered, your insurance company, will need those items.

Call your insurance company.

Well, we did have the police come out, what they did was allow me to get pictures then give him a statement and information then told me to go away and leave.
but I am just worried that since its a used car that a bumper replacement might total a car, then I might be upside down. which is my worry. Then there is the medical stuff.

A bumper is cheap, maybe $500 with the paint.

As it's not your fault, the lady's insurance must cover everything.
It may offer you cash, but body work is not cheap these days.

If you worry about costs, take a trip to Tijuana and repaint the bumper there.

I learned a few things from a similar accident.
1. Make sure an accident report is filled out. I don't know about CA, but in OR the cop doesn't/didn't fill it out and you can lose your license.
2. No worries on your car. If it's just a bumper skin, they are cheap... as little as $100 to 500 plus paint/installation... around $1000-1500, paid by the Lexus.
3. Don't sign a medical waiver until it's all finalized. Your insurance will usually deal w/ the Lexus' insurance since it's not a total.
4. Go to your doc about your injury. If her insurance balks to cover it all, that'll be a ca-ching that'll draw lawyers like chumming the waters.

I had problems with the same kind of accident... hit so hard it bent the frame on my car. Despite being an $8K vehicle, I signed the medical before finalizing with Progressive. I ended up getting $2200, minus a $500 deductible. A total shaft, but nothing I could do. I should have greeted the adjuster in a neck collar and crutches.

If the police came, it'll file an accident report to Carfax. Nobody will buy your car.

As a retired LEO, Always call the police that way you have an official report on file even if nothing comes of it.

I'll try and help answer some of your questions;

A lady in a Lexus ES 300H hit a white Toyota Pruis, then the Toyota pruis hit me. My 2014 VW Jetta TDI.

-This is a multiple car accident and therefore lots of liability, especially if someone was hurt. Unlike others have mentioned I would not inform your insurance carrier just yet until a determination is made by the other drivers insurance (assuming the driver of the first car has insurance). You can notify your insurance carrier and file a claim w/them for both damage to your car + medical if you have expenses and they will file a subrogation claim against the other driver if there is fault determined. Although at this time it looks like its a non fault accident on your part, its still an accident being reported and paid out against your carrier which could cause your rates to go up

I haven't have the car very long.

-Doesnt really matter until damages are determined

what if I get hurt from this?

-Go to doctor or hospital if you are truly injured and advise you were in a car accident. Your medical insurance will cover and if needed will file a subrogation claim against other insurance if deemed at fault

what if I need to get a new car?

-Your getting ahead of yourself, need to assess damages to your car

I dont know if I have the money for another down payment?

-Again, getting ahead of yourself

Hope this helps, be patient, accident just happened and unfortunately things may not move as quick as you like

I have a question? Are you hurt from this accident at the present moment? Is your car fixable? Have you had your insurance company appraised the damage to your car. Your insurance company should be able to deal with the other insurance companies, at fault.

My advise, get on the phone with your auto insurance. Have them pull the accident police report.
