I’ve been a huge fiat enthusiast, my first car was the FIAT POP, then upgraded to the ABARTH Model and last year I upgraded to a 2017 new FIAT 124 Abarth Spider. (automatic) The car has been running great but sometimes I noticed that while driving in Manuel mode the car would slow down by itself like downshift at first I didn’t think of it as anything and continued on. This past Saturday I was driving back home at night when I see a huge truck speeding up behind me. I begin to slow down to try to get away the truck to slow down but he doesn’t instead he cuts me off right infront of me and almost hit me. At this point I hit the breaks and try to turn my car away from him but my car downshifted again by itself causing me to lose control of the car.
This causes me to hit my front right rim onto the pavement and causes my right rim to break off the car completely. My passenger and I were luckily not hurt but it could’ve been way worse.
Yesterday i I decided to check to see if the car had any recalls regarding this matter and the car does have a recall. My specific model and vin # match the one that got recalled. Should I sue FIAT? They sent me no notification of the recal by mail, email or phone. What should I do? I emailed FIAT and they basically said they would get back to me in a day or two. But I’m debating whether I should sue them. Please see pics
