I'm not a lawyer or an employee of FIAT, just a car guy, so I'd say that if it's a widespread problem, then someone would have to initiate the legal action. From what I know, anyone or any legal firm can do this. They'd likely want to know all the details possible, how many owners have the issue, what percentage of owners have the same issue, etc.
If it IS a big problem with most or all 500e models, I'd expect that FIAT would address this with a technical bulletein or recall of some kind. I'm not up to date with 500e issues, so if I'm missing something I apologize.

how many 500e's are we talking about?

I really not sure how many Fiat Access users at Southern California. All I know is myself and my family members (five to be exact and all 2017 500e) are having the very same issues. The most frustrated issue observed lately is Fiat Access will not able to update beginning from 1:00PM to 8:00PM.
Below is the error dialog box pop up few minutes after forced update.
On Andriod--> Could not update the vehicle status: Network error.
On IOS (iphone) ---> Nothing pop up. just not update
The last updated occurred on 12:53PM today.....and completely dead until tonight after 8:00PM. (i hoped)
Twelve minutes after 8:00PM......It start working....

A grand total of about 20,000 500e have been produced since 2013: http://insideevs.com/monthly-plug-in-sales-scorecard/. It's difficult to guess how many customers have had problems with the remote app. I have a 2015 and it has actually worked well for me for past two years, but I've seen a good number of complaints on the forums of poor or inconsistent performance.
You'd think that given such specific circumstances (1pm - 8pm, affecting only 2016-2017 models), FCA should be able to quickly identify and fix the problem. I have to conclude that they don't care, or are simply incompetent.

bdapple: We live in SoCal, got our 2017 500e almost 3 weeks ago, Van Nuys Fiat. Love the car. The app sucks. Just like everyone else has described. Looking at my app right now (it's 3:35pm), last update was 12:57pm. I check it almost daily & see that it stops updating between noon and 1pm. Consistently, daily. It's a bummer. It will start to work tonight after 8pm-ish. Then stop again tomorrow. Wish it worked more consistently!
I really like my 2017 500e and I'm located at LA basin. The app start lost the connection or stop updating at 1:00pm until 8:00pm from the day one..

I REALLY hope you don't need an app to drive the 500e, not everybody has a smartphone, or wants to install another app on their phone just so they can drive a car. Also, maybe it's because the app hasn't been updated for iOS since 4 years ago in 2016, and since 5 years ago in 2015 for Android users! It does get 1.2 stars on the App Store which explains a lot.
